Delhi High Court bans OnePlus Technology to import and sell its mobile phones in India

The Delhi High Court has barred the China-based mobile handset manufacturer, OnePlus Technology from marketing, importing and selling its mobile phones in India. However, the court has allowed the company to clear its existing stock of OnePlus One smartphones in the country.

The order has come after consumer electronics manufacturer Micromax Informatics Limited filed a petition against OnePlus alleging violation of the former’s exclusive rights to integrate and distribute Cyanogen’s technology in its devices in India. Micromax has acquired the rights by an ambient services and application distributions agreement with US-based software developing company Cyanogen.

Micromax has, therefore, complained that OnePlus has infringed the rights by launching its OnePlus phones with Cyanogen operating system.

On the contrary, OnePlus has claimed that it had entered a collaboration agreement and trademark licence agreement with Cyanogen in February 2014 to use its trademark and software across the globe (except Mainland China). It added that Cyanogen informed the company about the termination of their agreement only 15 days prior to its launch in India.

As a result, Micromax now holds an exclusive licence for South Asia, while OnePlus has a non-exclusive licence for the entire world except China for using Cyanogen.
